California law defines sexual harassment in 2 ways: Quid Pro Quo and Hostile Work Environment. Quid Pro Quo includes demanding sexual favors in exchange for employment benefits or by threatening negative employment actions. A quid pro quo sexual harassment claim occurs when a supervisor leverages their actual or perceived authority to solicit sexual favors from an employee, with the threat conveyed either directly or indirectly. A hostile work environment includes conduct directed at a claimant or others, or a widespread of sexual favoritism.
